Legal Question in Credit and Debt Law in Indiana
Wife's credit card summons
My wife has a credit card in her name and she is a stay at home mother. We received credit help from Expert Debt Consolidation. A credit card company chose not to work with this company and my wife received a summons to accept the amount or dispute the amount. My question is can the credit card company come after me, her husband, to repay the debt? What does she file with the court? Thank you.

Re: Wife's credit card summons
If the credit card is solely in your wife's name, the credit card company cannot come after you. As for what your wife should file with the court, this depends on whether your wife wants to fight the dispute. If she owes it, then fighting it does not make much sense, especially if she has no means of paying it off. If she disputes the amount and the difference is material, then she may want to do fight it. If the case is in small claims court she can show up and does not need an attorney. If it is in the regular court, then she would probably do well to get an attorney as she will be overwhelmed with the process.
