Father Seeks to Enforce Visitation
I have been trying for two years to get visitation with my son. He lives in Indiana with his mother and I live in Florida. I am not represented by an attorney so everything I've learned has been from Indiana Code, bulletin boards, legal websites, etc. Last week I flew to Indianapolis for a hearing in response from my Contempt Motion. The judge did find her in contempt and ordered me make-up visitation as well as travel costs. I was ecstatic and immediately flew home and bought him a plane ticket for Thanksgiving. I called her last night and she told me she is not sending him and hung up on me. I've tried calling several times but now she doesn't answer. Now what? Did I win...but not really? Is the contempt order enforceable or do I have to file another contempt order? I'm at a loss as to what to do now.

I am not an Indiana lawyer, so I am evaluating this based on Florida law and procedure. I would suggest you call the judge's judicial assistant and tell her what has happened and ask what is the best procedure. Typically, you would seek sanctions against her for her failure to comply with an order of the Court. I am sure there are additional remedies, but you need the Court there to make this an emergency and get it done asap. Ask if you could appear by telephone to save yourself from flying up there if possible.
