Legal Question in Medical Leave in Indiana

Family Medical Leave

I work 30/hr./wk for Kohl's Departmnt Store. I was involved in an auto accident that will cause me to miss work for about 1-2 months. I am considered a permanent part-time employee. I have worked for Kohl's for 2 1/2 years. Am I entitled to FML with pay or is that a decision based on corporate policy? Might I qualify for unemployment?

The federal Department of Labor has a FAQ for the FMLA. It is a federal law and trumps and employer's policy.

If you worked more than 1,250 hours in the past 12 months, then you likely would be eligible for FMLA leave regardless of your employer's policy.
