Legal Question in Civil Litigation in Indiana
Hello, I filed a lawsuit in small claims against a popular auto repair shop for damages, and the judge ruled in my favor. The thing is that this is supposed to be a corporation I was suing, I contacted the corporation regarding payment and learned that the auto body shop is franchised and is listed as a different name. The lawyer that showed up during the hearing stated he was representing the corporation, and once I informed the corporation that the attorney stated he was representing them, they stated that the business was listed under a different name and they do not have anything to do with my case. They provided me all the contact information for the auto body shop (which name is different from the corporation), and I received a call from a local manager stating that they were going to appeal the decision. My question is can I file another lawsuit against the company (the auto body shop) because the lawyer was not representing the corporation and lied under oath. The corporation was not aware of lawsuit, and stated they do not have anything to do with my case. I want to file a lawsuit against the auto body shop who is lying about there name. This is probably confusing to you as well to myself.

You can sue the proper entity at any time, as long as you haven't sued that entity before.
