Legal Question in Landlord & Tenant Law in Indiana
Hello,
We are currently living in a home that we were doing a lease on that is now in Mortgage Default, because the homeowners have not been making the mortgage payment. We have been making our payments every month, directly to their bank. We found court papers on our front door in March stating they are being sued by the mortgage company. Our lease was up in April and we were told by the homeowners we could live here on a month to month basis. They have basically said they are letting the bank take back the home.
Since March there have been several bad storms and there is considerable damage to the roof. We know that if they are not paying the mortgage, they are not going to pay the deductible to have the roof fixed. We are tired of the paying the monthly rent to them, knowing the home is in default and we are going to have to move at some point. Also we are tired of paying the same rent for a home that is now is shambles and no future of being repaired.
What can we do with this situation?

Since you are on a month to month, give thrty days written notice and move out.
