Legal Question in Personal Injury in Indiana

Child injured & noone notified

10 yo daughter hurt her arm on the playground early in the day. She was sent to the nurse who told her it was a sprain and sent her back to class. No call was made to any family member to notify about the injury. Daughter spent all day in school and went home on the bus. As soon as she got home, we saw that the arm was very swollen & didn't look right. We took her to the hospital & found out the wrist was broken. Do we have a lawsuit against the school?

Unless the delay in treatment caused your daughter significant additional harm, I would not recommend a lawsuit. The nurse may have been negligent, but unless significant harm resulted from the negligence, any recovery you might receive would likely be eaten up by the costs of the litigation. Larry
