Legal Question in Real Estate Law in Indiana

My mom and dad purchased a home together and are both on the deed. My father was able to refinance without my mom being on the new loan and she didn't realize this either at the time it was done. For a long time my mother and father have been struggling with their relationship and she wants to know what would happen if they got a divorce because she can't work and she needs the money that she would be entitled to from the house. Would she get that?

The answers to your questions depend a lot upon the wording in the deed, the terms of the loan, and whether or not there is a mortgage securing the loan. I would suggest that you gather copies of all of the relevant paperwork and take them to an attorney for a review.
