Legal Question in Sexual Harassment in Indiana
Can I file a law suit?
I was recently pinched on my boob by a floor person(right under supervisor)with a pice of plastic at work. He was suspended only for 3 days. The reason he was not fired is because he wrote an apology saying it was ''accidently'' done. I have too many witnesses to other comments made about the incident for him to say it was an accident. I was also under the impression by a few ''upper'' individuals that he wouldn't work there much longer. Some days I have such a hard time at work because I feel he should have been fired. Every time I look his way I just want to hit him. There is much more to this I was just wondering if I have grounds to file a law suit against them?

Re: Can I file a law suit?
Probably not at this time. If an employer takes immediate and appropriate corrective action in response to a complaint about a non-supervisory co-worker, it generally is not liable for sexual harassment. On the other hand, if you have any further problems with this co-worker, it could be argued that it was inappropriate to keep him on the job the first time around (since that gave him another opportunity to harass you).
