Legal Question in Wills and Trusts in Indiana

Estate distribution

My father died several months ago w/out a will. He lived with my step-mom. He had 2 children. After discussing the matter with my step mom she has agreed to open his estate and has got an attorney. He had homes and bank accounts in 2 states. Do I also need to get an attorney or can I count on probate to get things legally distributed?
