Legal Question in Bankruptcy in Iowa

Small claims filed against me prior to filing bankruptcy

What can be done about small claims actions that have already been taken if I am intending to file bankruptcy within the next 30 days? I am in the process of finding an attorney in my area that will handle my claims and which I can reasonably afford but am unable to meet the demands of the small claims action at this time. Can I merely state my intent to file, although I don't yet have a case number? I was given 20 days from the date of service to respond to the action. I am at a loss as to what steps I can take prior to my bankruptcy filing.

Re: Small claims filed against me prior to filing bankruptcy

I don't fully understand your question. You seem to indicate that several "claims" are owed to various creditors. It seems as if one creditor has filed a lawsuit against you. You have 20 days to respond to the lawsuit. In order to buy yourself some more time you should file an "answer" in response to the lawsuit (any lawsuits you have). It would be best if an attorney filed this document but you could probably file one yourself. Also, once you have actually hired a bankruptcy lawyer you can tell the creditors your filing bankruptcy.
