Legal Question in Family Law in Iowa

College Support

My daughter graduates from high school next year. My court decree states ''If the children of the parties continue on post-high school education, the Court shall retain jurisdiction to determine the appropriate amount of support to be paid by each of the parties.'' How do the courts enforce this provision? Does a parent ask the court for a modification regarding college support? Also, does child support end automatically or is it necessary to request a modification for that too?

Re: College Support

I think I'd bring the matter before the court. That's going to require the services of a licensed attorney unless you feel up to it. The court doesn't enforce the provision, you do it through an appropriate court order.

The jury's out on whether support ends automatically. I'd say no, but if support is retained that is ultimately found to have been contrary to law or court order a person could be liable to pay it all back to the obligor.
