Legal Question in Personal Injury in Iowa
Employee's blood in french fries @ fast food restaurant
My husband recently ate at a popular fast food
restaurant. After almost finishing his french fries,
he found spatters of blood inside the french fry
box along with his few remaining fries.
The restaurant sent a letter of apology and some
coupons. Initially, they were very cooperative and
said they would have the employee's blood tested
for communicable diseases.
Suddenly, they are being totally uncooperative.
Each time I contact someone
from the corporation, they give me a another
telephone number and person to call. I have been
given at least 5 different telephone numbers from
the corporate office all the way down to the
insurance company. Their standard reply is, ''we
have been advised not to answer any of your
questions.''
I am angrier and more frustrated as each day
passes. Our question is very simple. Does this
employee have any diseases that we need to be
concerned about. My husband had a baseline HIV
and hepatitis screen. I have also contacted the
state health department in our area.
With the unanswered question regarding health
status looming large in our minds, I am afraid to
kiss my husband or be intimate with him.
What is your advice?

Re: Employee's blood in french fries @ fast food restaurant
Have your husband make an appointment with your family doctor. Give the doctor a clear history of what happened including dates, places and a description of what occurred. Ask the doctor to run whatever blood tests he deems appropriate. Make sure you discuss with him whether the tests need to be repeated if the results are negative. If unfortunately the tests come back positive, you should immediately consult with an attorney.
