Legal Question in Employment Law in Kansas
No Compete Clause
I was just a regular employee, then I became manager. Then the company got rid of all managers and put us back to regular employee's. When I became manager I had to sign a paper that said if I quit I could not work for another DME company for two years. My question is that now that I am a regular employee does that make that paper void? Because regular employee's do not have to sign this, only managers do.

Re: No Compete Clause
Hate to sound like a lawyer but I'd have to see what the non-compete says. I suppose one argument that you could make is that the consideration for the non-compete has failed--the promotion to manager, thus it is no longer valid. However, I would want to see your document before giving a more detailed answer.
Thanks for your question. Let me know if I can be of further help.
