Legal Question in Employment Law in Kansas

Teaching Special Ed. age groups older than one's K-9 certification

Can a tenured teacher in KS, certified in Special Ed. K-9, be forced into teaching Secondary aged students in a special purpose school? Does the age of the student or the curriculum/ lesson plan taught determine the grade level? Does a school district need to show any ''good faith effort'' in keeping a K-9 certified teacher in these grade levels? Do different rules apply to Special Ed.?

I don't know the answer to your question but I have two starting places for you to find out. First, do you have a collective bargaining agreement or other contract? That may discuss re-assignment. Second, are you a member of KNEA? If so, KNEA has an attorney in Topeka who answers these types of questions. If you are not a KNEA member, I would strongly suggest you join, particularly if you need a lawyer.

Good luck with your issue.
