The first remedy is a workers compensation death claim. Workers Compensation is a no fault system, so the cause of the death does not matter. However, in addition to workers compensation, there may be a third party remedy here. To determine that will require a thorough investigation by a competant personal injury lawyer, preferably one who is also experienced in workers compensation. If I can be of assistance, let me know. No charge for initial consultation.
