Legal Question in Wills and Trusts in Kentucky
Adult Children Rights
My mother passed away in January. Her will was written in 1986, while my sisters and I were still minors. In her will, she states what we should receive at the age of 18 if she shall die while we are minors. We were all in our 20's when she died. Are we entitled to nothing now that we are grown? Also, she had a prior life insurance policy through work which stated my stepfather receive 49% and each of us girls, 17%. After taking off work for a while, it was deemed void, and another beneficiary form was never found. Due to the above, my stepfather now has 100% of my mothers belongings, estate, and life insurance policies. He has left me and my sisters with nothing. Do we not have ANY rights whatsoever?

Re: Adult Children Rights
First, please accept my condolences over the loss of your mother. It is next to impossible to provide an answer to your questions without seeing both the will and the insurance policy. Most parents make alternate provisions for their children for before and after they become legal adults. Has your stepfather taken steps in probate court regarding the will? If so, you should have been notified and have an opportunity to present your side to the judge.
