Legal Question in Elder Law in Kentucky

guardianship fund misappropriation

My daughter's maternal grandmother has Alzheimers and is in a nursing home. A relative was appointed her guardian over 5 years ago and has control of her substantial assets. We get an annual court filing showing assets and disbursements of funds during the prior year. We can see from the disbursements that the guardian is paying some of his personal bills and writing checks to his wife's relatives for ''services'' from this account. He does have a surity bond in place and there is an attorney filing the annual reports with the court but he never questions the disbursements. My daughter doesn't have the funds to hire a lawyer to expose this to the court. What can she do?

Re: guardianship fund misappropriation

You should call the local Adult Protective Services (APS) office and express your concerns. APS has the power and the obligation to investigate the guardian's use or misuse of money and to take further action if your concern is verified.

Best wishes.
