Legal Question in Family Law in Kentucky

Alimony or Maintenance

A couple married in 1962 and are still married. Wife is physically abused but other than 2 trips to a women's shelter and visits (alone) to a marriage counselor there is no record of the abuse. Only her family knows and everyone else thinks they have a great marriage because he is a ''pillar'' in the church and community. She is afraid he will kill her if she leaves him because it will jeopardize his position in a conservative church. She has been told that about 10 years ago KY passed a law that no one can get alimony. Her husaband forced her to sign a paper so she can't get any of his pension if he dies. He dropped her from his medical insurance when he retired even tho it cost him nothing to carry her on it(she gets medicare now). The house was almost paid for and he forced her to sign a line of credit loan against the house and he keeps that ran up so when he dies she can't afford to keep the house. There are no minor children involved. She said she can't afford to leave him. Is alimony or maintenance granted in Kentucky courts? They have been married 40 years.

Absolutely! The abuse described should be reported to Adult Protective Services. His pension would be subject to equitable division in a divorce.
