Legal Question in Family Law in Kentucky

My brother got issued with a mental Inquiry Warrant while he was at the hospital, after he admitted himself. Does he have to to the hearing that is set for him? Also, the hospital is trying to get him to go a treatment facility that he does not want to go because of reputation. He does want help, but can he check himself out and pursue different options or is it all in the hospital's hands?

I am responding to your inquiry as a courtesy, not as part of an established attorney-client relationship. I was with the Mental Inquest Division of the Jefferson County Attorney's office for 18 years, and serve on the board of Mental Health America of KY. Your brother has a right to a hearing and under most circumstances would be required to attend. He also has the right to discuss his treatment plan with hospital staff, including any request he may have to go to "Treatment Facility A" versus "Treatment Facility B."

I hope this is helpful, and I wish you and your brother well.
