Florida divorce law vs Kentucky divorce laws

My Father left my Mother in Kentucky, He moved to Florida 3 years ago. He retired from Southern Bell of 38 years. My mother had breast cancer and has a spot on her liver and is in poor health. Dad sends very little money to her so that she is living at or below the poverty level. He now wants a divorce, leaving her with nothing, no insurance, no income, etc... They have been married for 43 years. She is too ill to move to Florida. Moreover, we know he did very well with his retirement. We also know she has not signed any income tax returns for 3 years or any other documents that need joint signatures. How can we help her get a fair divorce?

She will most likely need counsel in FL and KY. From your description of the circumstances, under KY law

she would be entitled to "maintenance" (a/k/a alimony).

Re: your narrower question, how can you help her, both emotional support for her and financial support

to assist in paying attorney fees would be important.

She simply goes to local counsel and be completly open about the situation. There may be issues of jurisdiction, etc but that can be handled through most local attorneys. Although there are differences in how various states treat marital assets, the one thing that they do have in common in marriages of this type is a way of applying equity, that is to provide a means where both parties share in the assets, including some retirement systems. You can provide help by giving emotional and financial help if she needs it. There are also support groups out there. She is not alone but this is not a "do-it-yourself" project. Let the attorney handle it.
