Legal Question in Family Law in Kentucky

inheritance and divorce

My sister's husband inherited $36K several yrs ago. Approximately 1/2 of this amt. was used to pay off jointly owned credit cards. The balance was put into his private acct. where it remains. He wants a divorce and wants their home sold. If they do divorce and sell the house, is he allowed to take what was paid on the cards from the proceeds of the sale. He is an alcoholic who received a liver transplant and is listed as ''disabled.'' He is drinking again and he is extremely verbally abusive. She is unemployed (having left her job to take care of him) and has only a small monthly income of $200. Is there legal financial protection for her? She has been married to him and taken care of him for over 30 years. What are her options?

Re: inheritance and divorce

Your sister needs to get a good divorce attorney "yesterday." I have no vested interest, as you are in Lexington and I am in Louisville and do not practice in Lexington. She needs an attorney to get a court order to freeze assets, get maintenance (alimony), and generally protect her legal and financial interests.

Good luck.
