What rights does a husband have regarding the home if it is in the wife's name?
Currently married, house is in my name. Please advise if I can have abusive husband removed from home prior to filing for divorce. I've been unemployed since 12/2001 and not in position to pay for a divorce. I have asked him to vacate the home, file for divorce but he refuses, says he won't leave until I pay him money which I obviously don't have. My 18 year old daughter and I live in fear each day of his moods, verbal abuse to her, and both verbal and physical to myself.

You would have to file for divorce and request the court remove him from the house unless you were able to take out an emergency protective order allegin incidents of domestic violence in which case you might not have to file for divorce immediately. please feel free to call to discuss further.

The Domestic Violence Intake Center's phone number is 595-0855, it is part of the Jefferson Family Court system, and you should contact the Center for advice (non-divorce). I believe it is open 24/7, but I am not positive.
