Legal Question in Family Law in Kentucky

I will be moving back to Kentucky to marry my fiance. We were planning to cohabitate until the marriage (30-45 days after my arrival). My fiance has a 9 year-old daughter with whom shes shares custody with the child's father (they were divorced 2 years ago). Can the child's father use our cohabitation as grounds to dispute the joint custody agreement?

This is not a direct answer to your query. To me, the real question is not whether he could "use our cohabitation as grounds to dispute the joint custody agreement," but whether he would attempt to do so. If so, regardless of outcome, this could get sticky and expensive. You and your intended should discuss the likelihood of his attempting to use this against her/you. Has he been litigious in the past? Does he carry a grudge, or do he and she communicate reasonably well with one another on child-related issues?
