Legal Question in Health Care Law in Kentucky

poa versus guardianship

What is the best one to have? I need to get info about what's best for my husband with his social security disability, va approval, military retirement. He had an injury to his brain & has little memory of details.

Re: poa versus guardianship

A POA is a voluntary arrangement. If your husband understands that the POA will allow you to care for his financial issues and voluntarily agrees, this would work. If he is unable to understand, or is unwilling, the guardianship, through the district court, would be the way to go. This involves a mandatory jury trial, which your county attorney would be responsible for handling.

There may also be variations on the POA/Guardian issue through VA, but I do not know anything abut them. Similarly, there is a Social Security payee program which you should investigate.

I hope this is helpful.
