Auto accident question

My husband was in a car accident recently. He was hit from behind and then hit the car in front of him. Can we be sued by the driver of the car my husband hit or is the driver who hit my husband responsable? My husband and the car in front of him were both at a complete stop. Also, would it be a waist of time to hire a lawyer to represent us or should we just let the insurance companies handle it? My husband has severe neck pain because of the accident. Thank you.

Legally, your husband can be sued for the damages caused when his car struck the car in front of him, but the ultimate responsibility still lies with the other driver. I would make the PIP claim with your insurance co. for interim payment of your husbands medical bills, file a claim for damages against the person who hit your husband, but let your insurance co. defend any actions brought by the driver your husband hit.
