Legal Question in Personal Injury in Kentucky

Auto accident - Rear-ended - Does ins. co. accept me as is?

I was at the front end of 5 car rear-ender. I sustained back, neck and knee injuries. The ''Other'' insurance company says my injury (complaints) were caused by arthritis, degenerative disease, obesity. In Ky. do I have to be accepted ''as is'' at the moment of the accident? Are past injuries, etc. irrelevant since this accident caused new injuries? Is there a KRS I can quote to prove this? Thanks in advance for taking my question.

The negligent driver(s) would be responsible for any

aggravation of your pre-existing conditions. A

friend of mine likes to make the point by saying

that if you were blind in one eye, and an accident

caused you to lose sight in your other eye, would

the negligent party only be responsible for one eye?

Clearly not.
