Legal Question in Personal Injury in Kentucky

Neck Injury - club/on water no statue of limitations

A few years back I was hit with a big 5 bulb dance/strobe light at a nightclub that is located on the Ohio River. The lights were a few days old and not tested properly against bass from the music. It fell roughly 15 feet from the ceiling. I was not the only one that was struck, another man a day before my incident was struck.Yucantan Liquor Stand is the name of the club. The light struck me in the back of the head and neck and I was treated by my doctor with ultrasound therapy, sleeping pills, pain pills and strict excercises. A lawsuit was filed and I was awarded money to pay my doctor bills and an extra $1000 for compensation. My question is, now a few years later I'm noticing that the top of my spine in my neck is starting to ''move'' or ''bulge'' out again, as I lay my head back, it's resting on my spine. Because the club was on water, I was told by my lawyer that there is not a statue of limitations. But my question is, if I have this looked at by my doctor and they find that due to the injury, my neck is again damaged, can I file another lawsuit, using a loophole of some kind so that I'm not suing for the exact same thing. This injury could be life-long. So I'm wondering what my legal options are.

Thank you for your time.

IF there was a settlement in the lawsuit, in all liklihood you signed a release of any and all future claims that you may have against the Bar and its insurance company. Any compensation for future care should have been included in the original settlement. UNfortunately you can not sue them again.
