Legal Question in Personal Injury in Kentucky
Stabbed at work.
I am a nurse, I was stabbed at work in November. WorkComp has been taking care of me to this point for medical bills, reoccuring infections, and Post Traumatic Stress Disorder. My question is based on this. The facility has had numerous intruders in the facility after hours, one was actually an escaped convict. The facility neglected to lock the doors to the Nursing Home down after hours even though they were aware of the problems and altimately as a result I was stabbed. Is there any legal recourse that could take place to compensate me due to the negligence of the facility?

You may very well have an excellent claim. It would be based around the theory that they knew they had a security problem, that dangerous people were known to break in and cause harm to employees, and that in fact one such person did breach "security" and injure you. This is tricky. If you were a visitor or resident,
you might well have a strong claim. As an
employee, your Workers Comp may "bar the
courthouse door" from a civil lawsuit. You should
seek legal counsel in your area who is familiar
