Legal Question in Wills and Trusts in Kentucky

Was my elderly mother ''scammed''?

My 78-year-old mother was contacted by a financial planner (after mailing in some sort of a reply post-card to AARP). A man (from United Financial Systems, Corp.)came to meet w/ her to discuss ''estate planning''. He told her she needs a living will and a trust (so that her 3 children will receive the bulk of her money, as opposed to ''the state taking everything''. She already has a will. This man explained that he was not an attorney but would see to it that an attorney drafted these important documents for her. She signed a contract & he charged her $2500.00 for this service. The contract doesn't specify what she'll receive for her $2500.00. What does a Ky attorney charge to draft a living will or set up a trust? Does she even need a trust if she already has a will? The attorney who drafted her will is dead now but she has a ''copy'' of her will. (PS: her assests probably total $250,000.00, her house & car are paid off & she really has no debt).

Re: Was my elderly mother ''scammed''?

I suggest that you contact Adult Protective Services

(595-4803 in Louisville) immediately.

It is similar to child Protective Services, & has power to

investigate abuse & neglect of elders, as well as:

(8) "Exploitation" means the improper use of an adult or an adult's resources by a

caretaker or other person for the profit or advantage of the caretaker or other

person (KRS 209.020).

Best wishes.
