Legal Question in Wills and Trusts in Kentucky
emergency power of attorney
My grandfather passed away in Kentucky. As far as we know there is no will. My aunt claims she got emergency power of attorney after his death. Is this possible?

No. Even a durable power of attorney given during life does not survive death, and the ability to grant a power of attorney requires the ability to sign the power, which after death is problematical.

I saw the response from the attorney in Virginia, and thought you might want to know that the answer is the same in KY. At most, your aunt could have gone to District Court to be appointed Administratrix of your grandfather's estate. If so, there would be a court record.
