Legal Question in Wills and Trusts in Kentucky

Executor will not distribute estate funds out of anger.

My uncle (executor) of my great grandmother estate

refuses to distribute estate funds to me, my brother and

mother. All 4 of us are equals in the estate. Uncle is

furious because my brother and I (both adults) are in

the Will and his 12 month old daughter at time of death

was not. It's been 10 months since he became PR. No

claim is holding up this simple estate of $132K. Money

is sitting in the bank for 4 months now.

Can we do anything to force him to distribute the funds?

Can we file something in court without a lawyer?

This is intended as a quick overview-type response to your inquiry. You may file a motion in Probate Court requesting distribution. Your uncle will have to file papers anyway regarding his handling of the Estate, and will need to explain to the Court what he has done with assets. Courts allow nonlawyers to file papers on their own behalf, but the judges will not always go out of their way to assist nonattorneys. Also, with three people involved, all would need to sign papers.
