Dear LawGuru Friend,

You give few facts here, but my thinking

is that an engineer could contract with

a third person to perform engineering services

and as a part of the "contract" or agreement,

the other party could agree to waive certain

rights to hold the engineer liable for for defective

or sustandard work. Of course, a contractee

would not be wise to do so, unless his doing

so was a factor to be figured into the engineer's

price for doing the engineering work/consultation,

etc. Feel free to e-mail me your name and

phone number if you would like to discuss this

further with me. There is no charge for my

consultation.

Sincerely,
