Can I sue my contractor?

He laid my wood floors in May of 2007. Within weeks they started to buckle. He has made numerous attempts to repair but they continue to pop up. The last time he came to repair was in May of 2009. At that time I noticed that the problem may be due to the fact that they did not put down a moisture barrier. He assured me when they were installing that they were putting tar paper between the flooring and subfloors. After further investigation I have found out that my 30 year manufacturer warranty on my floors is null and void due to the fact that they did not use a moisture barrier such as tar paper. What can I do?

You can sue the installer. Failing to put down a moisture barrier on a hardwood floor is certainly a negligent installation. The entire floor will need to be reinstalled. If he will not do it (at his own cost), you should get estimates from other reputable companies for a complete reinstall and file suit for that amount.
