Legal Question in Consumer Law in Louisiana
Service Business Disposes of Customer's Property
Over a year ago I dropped off 2 suits (one man's and one woman's - both only worn once to a wedding) to a local cleaners. I kept forgetting to go pick them up. A couple months ago I call the cleaners concerned about my clothing. They said the suits were still there and said that before they did anything with items left at the cleaners, they would either call the customer or write them a note. I called last week to find out that my suits were given to the Salvation Army. I did not receive a phone call nor a note stating they would be taking this action if I did not pick up the items. They totaled over $350.00. Should I expect reimbursement for the cost of the suits?

Re: Service Business Disposes of Customer's Property
Most cleaners have a fairly well published policy concerning the length of time they will hold clothes until they consider them abandoned and dispose of them. You left the suits for over a year, and then, after learning they were still there, you still did not pick them up for over 2 additional months before calling to be told they had been given away. You certainly have a right to seek the value of the suits, but I suspect the court would be very reluctant to award you anything since it appears for the last year and a quarter they were not worth much to you.
