Re: debt collection

Dear Law GuruFriend,

In answer to your question about a company's attempting to collect on a fifteen (15) year old debt, I say that the odds are pretty good that that debt is now legally enforceable. Many collection agencies or collection operations buy debts that they even know are worthless, but then they harrass the debtors into paying them or making a cash settlement for a percentage of the amount they claim is due. There is, of course, more to it all than this; but this is something to consider. If I were a gambler, I'd lay money on a bet that said that the debt is now unenforceable and uncollectable. Good luck to you and yours!

Sincerely,

P.S.: If it is a student loan, then the answer might be different; but even then I would not get in a rush to pay it. Of course, there is always the so-called "moral" obligation that a debtor might not want to leave unresolved. That's another matter, however. HMP
