changing my son's last name

My 8 years old son currently has his biological father's last name, he rarely sees him and he is over 4 years behind in support. My son wants his last name to be my current husbands, because that is who he knows as dad and I am currently 7 mths. pregnant and he wants to have the same name as everyone else in his home. Do I need the biological fathers signature to change my sons last name to my married name? Does my husband need to legally adopt him to change the last name or is it easier to change my sons last name to my maiden name?

I always choose adoption when I am asked my opinion. If you son considers your husband as dad, then lets make him his legal dad. And you son can then inherit from his bio-dad and his new dad. It is not hard to accomplish an intrafamily adoption.
