Child Custody

A father is in college in Oklahoma, the mother of his kids is in jail in Mississippi and she gave temporary custody to her mother in Louisiana, but she now wants the father to gain custody of the kids but the grandmother is not willing to relinquish the rights. What steps does he need to take to gain custody of his kids. Does he need to file for custody in Mississippi or Louisiana. Is free legal aid available since he is a college student?

First I am only answering this to try to put you on the right track. I am a TX attorney and do not know the law of MS or LA. I doubt that free legal aid is available in any of those states or OK to help you with your problem. You can ask but I bet that is going to be the answer. Second, the mother could not give temporary custody to the grandmother. Only a court and a judge can grant custody of any kind. But, I think you will have to go to where the Order originated (MS?) to get that judge to issue an order to enforce your motion to modify custody. Then you will have to take that order to a LA court to get them to take the children from the grandmother and take them back to MS. Then you can start the process to see if you can get custody. You see the $$$$$ starting to pile up. Hope that fits into your plans. This is an expensive process and I doubt that anybody is going to help you pay the bill. Good Luck.
