Legal Question in Family Law in Louisiana
I'm asking this for a close friend. He is 19 his girlfriend is 18. They had a child when she was 16. They didn't put him on the Birth Cer. He didn't think it was his, he did a DNA. It come back that it was his and he is paying child support. The girl's mother has full custody/mother of the child. His question is if he has to pay child support, than shouldn't the girl have to pay child support to her mother for caring and has custody of the child. He has not problem paying his child support, just with the baby's mother would have to pay also? Thanks for you attention and help with this question. When the child is 5, then the State begins to assign an income amount to the mother, whether working or not. Child Support is a formula set forth in the LA Civil Code. A percentage of the total amount of support is assigned to each parent, though only the parent who doesn't have true 50-50 custody actually pays. This parent doesnt pay theentire obligation only the percentage assigned. If there is true 50-50 custody, neither pays an amount to the other. He really should get himself in a position that he can have custody of his child or at least joint custody.
