I am currently under a situation that my wife got re-married and not getting a divorce from me.

I agree with Ms. Brochstein. To go a bit further, I suspect you want to get your wife in trouble but her being served with the Divorce Petition will take care of that.

You still need to file for divorce. If you live in TX for at least 6 months, then you are a TX resident and can file here.
