Step Parent authorized to sign medical treatment?

Does a stepmother automatically have the right to bring a step child to the pediatrician? There were no documents signed by biological parents and because her last name is now the same as the bio father she signed as ''Parent/Legal Guardian''. Bio Parents are in an interim custody situation right now. What are the consequences for this action?

I do not see anything wrong with this. All must assume the biological father allows his wife to take his child(ren) to the doctor.
