Legal Question in Family Law in Louisiana

What happens if you don't use all of your visitation rights?

I have joint custody of my kids. I get them every other weekend and holiday and I am supposed to get them for the summer. I have to pay child support every month, but in order for me to make enough money to pay child support and keep a roof over my head I sometimes can't take the kids on the weekends I am supposed to and I don't take the kids over the summer, because I am supposed to still pay child support even though they are staying with me and because of this I can't afford to take the kids during the summer. I pay my child support every month. How much trouble can I get into for not taking the kids? My X-husband is threatening to take me to court. Please help!!!

If you have to work weekends and can't take any time off in the summer, it sounds like you aren't budgeting right or you are paying too much child support. You need to do better budgeting, get a reduction in support, or have your visitation revised to reflect what you can live up to. I can't see any real "trouble" you can get into by not exercising your visitation, other than having it reduced.
