Effects of Katrians on pending cases

What happens to pending lawsuits in New Orleans that were docketed for this week and next? What happens if clients files are lost? Is there a duty to back up files just in case such a disaster occurs? (this is for a class assignment)

You are asking questions that many lawyers in New Orlenas and the surrounding areas would like the answers to as well! AS the previous poster indicated, all cases have been postponed right now. Thus, everything will simply sit where it is until the court is able to get back up and running. HOPEFULLY, the court does have electronic backups of all the files - we'll just have to wait and see. At worst, the clerk's office for CDC is on the 4th floor and the water certainly didn't get that high (unless there was roof damages to CDC that would have allowed water to get in).

Any cases pending in N.O. are continued till further notice. I am certian the clerk of court microfilms all records and has copies safely stored in one, or more, safe locations.
