What to do with a Petition for Damages
Last Nov my son(11) was in a line shaking hands after a football game.The kids were playing around and he bent the right thumb of another player.We went to the parents to ask if the child was ok.They said yes,and the injured child came to an after game party,with ice on the thumb.The next morning we called the family to check on the child and told them to let us know if there was anything we could do.A few weeks later we received a letter from an attorney on their behalf.We pay an insurance fee to the playground before each sport.We turned the information over to the playground insurance co.This was in December 2004.Last we heard.On today we received a ''Petition for Damages'' The injured child has participated in three other sports since the injury and he and his parents have verbally told us when asked that he was ok.In the petition,they site what they must believe to be our homeowners insurance co.We are not homeowners and therefore do not have homeowners insurance.There are no dates to appear in court on the letter.What do we do with this petition and what other course of action should we take?

Contact a lawyer immediately. If you do not make a timely answer to the petition these people can get a default judgment against you. That lawyer can advise you fully.
Because homeowners insurance sometimes covers negligent injury it is not uncommon to sue the insurer in this situation.
