Legal Question in Immigration Law in Louisiana

I am a US citizen and live in Louisiana and my fiancee is from Honduras but came on a visa that has already expired. We are making plans to get married soon and wanted to know what the process is that immigration requires for him to become legal and will he be required to go back to his country while waiting for his legal documents or is he able to stay and wait for them here in the USA?

If your fiance came to USA on a visa, which had already expired, and has a passport with an expired visa and a card I-94 attached - then, after the wedding he wouldn't have to go back to Honduras to apply for a visa and should be eligible to apply for a Green Card (permanent residency) through an immigration process known as 'adjustment of status' as a husband of a US citizen (provided that he is not ineligible for adjustment).
