If a company gives employees their vacation up front, are they required to pay an employee their unused vacation time if employee leaves the company? Example- January 1, of each year every employee that as been with the company for at least a year will receive 40 hours vacation to use within that year. Because it is given upfront by the employer, or they still required to pay the employee upon the employee leaving the company?

It depends on what the vacation policy says. You would need to review the policy to determine whether vacation is "earned" and therefore payable, or whether it is a gratuity and perhaps not payable.
