If an employee just walks out without notice do you have to pay them their vacation time? Our policy states "Failure of an employee when resigning to give proper notice results in the forfeiture of annual leave.

The answer may depend on what else your policy says. Generally speaking, the policy you have, in my opinion, is an illegal wage forfeiture provision if the annual leave time is earned. So, if your policy states that an employee earns annual leave time, then that time cannot be forfeited for failure to provide notice when leaving.
