Legal Question in Employment Law in Louisiana

If I resign from my job and I have unpaid leave and my employer (private sector) refuses to pay it because I left their company is this legal? there is no employee handbook and my pay statement clearly shows that I have unpaid leave. Does it matter if I give proper notices of my resignation?

It depends on if your leave was "earned." If it was earned, then it is owed up termination or resignation, regardless of whether you provided notice or not. I would need to look at the policy to determine if it is owed. If there is no policy, then I would need to talk to you about how the leave was provided. Failure to timely paid earned wages could also entitle you to penalty wages and attorney's fees as well.
