Re: apartment cleaning fees

Your question is a little difficult to understand. If I am reading it correctly, it appears that the manager of your current apartment is threatening to evict you unless you pay an alleged debt to a former landlord.

I assume you have already signed a lease for this new apartment. If you have a written lease, your landlord cannot cancel that lease because of some alleged debt arising out of a former lease. If he tries to evict you for that, he could be liable for failing to deliver you peaceable possession under your lease. Once the lease term is expired, however, the landlord will be free to refuse to renew your lease at that time.

If you do not have a lease, Louisiana law states that you are under a verbal month-to-month lease. That month-to-month lease may be cancelled by either side with ten days' notice. In other words, if you have no lease, the landlord can tell you to leave on the first of the next month so long as he gives you notice to vacate by the 20th or 21st of the previous month, depending on the month.
