Legal Question in Personal Injury in Louisiana
Parked Car Accident
I was visiting my son's home new years eve. He and several of his friends were standing around outside drinking. One of his friends received a phone call and became enraged he jumped into his vehicle put it into reverse and rammed the vehicle side ways into a tree which brought the vehicle to a stop . He again proceeded to back up to fast to control the vehicle and rear ended my vehicle. The cops were called and they arrived at 12:09am new years day and filled a report. Their were no injuries.
It was obvious he had been drinking but the cops mad no move to arrest him they took down my insurance information but he couldn't find anything but a receipt. The first time I called him he told me he had progressive but he could not find his information he would call me back with the details. I contacted progressive and they told me he did not have insurance with them.
Here it is two days later and he refuses to return my calls. My question is do I have any recourse?

Re: Parked Car Accident
Yes. If you have UM property damage, you can get your insurance to pay for it and they can go after the guy themselves. That should not affect your insurance premiums. Or you can go to city court or small claims court and sue the guy for the damages.
