Legal Question in Personal Injury in Louisiana
Personnel Injury
Is there a time table to get medical care after a car accident? I heard you must seek medical attention within 72 hours after an accident. I was rear ended several months ago my car was a total loss. I hand neck, back and shoulder pain after accident. At the time I was unemployed and could not afford the medical bills. I am still in pain after several months. Not to mention it took over a month for the at-fault insurance company to contact me. I got low balled on my car because they only hand $10,000 property damage insurance. Blue book was $14,000. Can I sue for the balance? I have not signed any releases.
Thanks.

Re: Personnel Injury
There is no magic timetable for seeking medical attention. There is a reduction in credibility if you take too long to get the care.
Contact a lawyer immediately. Many lawyers can, if they consider the case strong enough, direct you to a doctor who will defer payment until the case is settled.
Re: Personnel Injury
There is no time table for seeking medical treatment. Obviously a question will arise whether the only reason a person is seeking medical services is to build a case but many times injuries do not manifest until later or there are financial reason for not seeking medical help earlier. You can sue for the excess but the party who caused the accident will be the responsible person for the excess of the insurance available. Hope this helps and good luck.
